Privacy Policy

Please read this Privacy Policy carefully before using the Podwell application (the "Application" or "Podwell") created by Luke Southwell-Chan ("Developer", "us", or "we"). This policy describes the types of information we may collect or that you may provide when you download, install, access, or use Podwell, and our practices for collecting, using, maintaining, protecting, and disclosing that information.

This policy applies only to information we collect in the Application and through email, text, and other electronic communications sent through or in connection with the Application.

By accessing and using Podwell, you ("User") acknowledge that you have read, understood, and agree to this Privacy Policy. If you disagree with any part of this policy, please do not use the Application.

We may modify this Privacy Policy at any time and any such modification will be effective immediately upon posting.

Information We Collect

Podcast Data

Podwell stores your podcast subscriptions, playback progress, queue, and listening history locally on your device and, if enabled, syncs this data across your devices via Apple's iCloud (CloudKit). This data is stored in your personal iCloud account and is not accessible to us.

Analytics

We use TelemetryDeck, a privacy-first analytics service provided by TelemetryDeck GmbH (Von-der-Tann-Str. 54, 86159 Augsburg, Germany), to understand how the Application is used. The processing of this data is based on our legitimate interest in improving the Application (Art. 6 para. 1 lit. f GDPR).

TelemetryDeck anonymizes all data using a double-hashing method before it leaves your device. The data does not allow any conclusions to be drawn about personal information. No IP addresses, cookies, or persistent identifiers are collected or stored. TelemetryDeck does not track users across apps.

Anonymized data collected may include usage patterns (e.g., features used), device metadata (e.g., device type, OS version, app version), and a rounded timestamp. The TelemetryDeck SDK is open source. Further details are available at telemetrydeck.com/privacy.

Crash Reports

If you opt in to sharing diagnostics with app developers through your device settings, Apple may provide us with anonymized crash reports and performance data through App Store Connect. This is controlled by your device settings and Apple's privacy policy.

Payments

We may offer paid products and/or services within the Application (such as Podwell Premium). Payment is processed entirely by Apple through the App Store. We do not store or collect your payment details. That information is provided directly to Apple, whose use of your personal information is governed by their privacy policy at apple.com/legal/privacy.

Data Storage and iCloud

Podwell uses Apple's CloudKit to sync your podcast subscriptions and playback data across your devices. This data is stored in your personal iCloud account under your Apple ID. We do not operate our own servers and do not have access to your iCloud data.

You can disable iCloud sync at any time through your device's iCloud settings.

Third-Party Content

Podwell accesses podcast feeds and content hosted by third-party providers. We do not control and are not responsible for the privacy practices of podcast publishers or hosting platforms. When you stream or download a podcast episode, your device connects directly to the podcast host's servers, which may log your IP address and other connection information in accordance with their own privacy policies.

Data Retention

Because we do not collect personal data, there is no personal data for us to retain. Anonymized analytics data is retained by TelemetryDeck in accordance with their data retention policies. Your podcast data remains in your personal iCloud account and on your device under your control.

Your Rights

Under applicable data protection laws (including the GDPR, if you are in the European Economic Area, and the CCPA, if you are a California resident), you may have certain rights regarding your personal data, including the right to access, correct, delete, or port your data, and the right to object to or restrict processing. Because we do not collect or store any personal data that could identify you, there is no personal data for us to provide, correct, or delete. If you have questions about your rights or believe we hold data about you, please contact us.

International Data Transfers

Anonymized analytics data processed by TelemetryDeck may be stored on servers located within the European Union. TelemetryDeck GmbH is based in Germany and processes data in compliance with GDPR. As the data is fully anonymized, it does not constitute personal data under GDPR.

Security

The security of your data is important to us. Podwell stores your data locally on your device and in your personal iCloud account. We do not operate servers that store your personal data. However, no method of electronic storage is 100% secure, and we cannot guarantee absolute security.

Children's Privacy

Podwell is not designed for or intended to be used by children under 13 years of age. We do not knowingly collect personally identifiable information from anyone under 13. If you are a parent or guardian and believe your child has provided us with personal data, please contact us.

Your California Privacy Rights

If you are a California resident, California law may provide you with additional rights regarding the use of your personal information. Because we do not collect personal information as defined under the California Consumer Privacy Act (CCPA), there is no personal information to disclose, sell, or delete. Changes to This Policy

We reserve the right to update or modify this Privacy Policy at any time without prior notice. Any changes will become effective immediately once posted. Your continued use of the Application after changes constitutes acceptance of the revised policy.
